Most tenants in New York expect their landlords to increase their rent yearly. However, many tenants do not understand that some rent increases may be illegal. Read on to find the NYC rent increase laws and limits on how much landlords can increase your rent in 2022.

How Much Can a Landlord Raise Rent in NYC in 2022?

Most rent increases rarely exceed 5% of your current rent amount in New York City, but the exact amount your landlord can raise your rent depends on what type of apartment you live in. If you live in a free-market building, there's no limit on how much a landlord can raise the rent as long as they give you proper notice. However, if you have a rent-stabilized apartment or rent-controlled apartment (i.e., a rent-regulated apartment), you have protections under New York State law regarding how much a landlord may increase your rent. Keep in mind that over 50% of the apartments in New York City are classified as rent-stabilized apartments or rent-regulated apartments.

NYC Rent Increase Laws for 2022

If you reside in a rent-stabilized apartment, by law your landlord cannot increase your rent beyond a certain percentage anyways. Specifically, each year the NYC Rent Guideline Board sets a cap on how much a landlord may increase your rent annually. In June of 2022, the board set a 3.25% increase for one-year lease agreements and a 5% increase for a two-year lease agreement. This will apply to all leases signed between October 2022 to September 2023. This means that if your current rent were $1,000.00 according to the guidelines, your lease renewal could not exceed $1,032.50 for a one-year lease renewal or $1,050.00 for a two-year lease renewal.
